Nintendo requests default judgment in piracy case after defendant fails to respond (UPDATES)
There’s one way to make sure you’ll lose to Nintendo in a courtroom situation, and that’s by ignoring their requests.
A few months back, Nintendo had gone after a moderator on a Switch piracy subreddit, but they also were the person behind a number of piracy sites in general. Nintendo says that they asked the defendant to shut down their operations multiple times, but they refused to do so. This led to Nintendo filing a lawsuit.
Fast-forward to today, and we find out that the person behind the piracy accusations has failed to respond to Nintendo. With that in mind, Nintendo has now requested default judgment in the case, which would mean Nintendo would be granted a decision in their favor. If/when that judgment is made, we’ll bring you the full details.
UPDATE: In the latest update on this situation, the case has now “entered default,” as the defendant hasn’t offered any defense in the allotted amount of time. This means the case can be closed without a court hearing, so long as the court doesn’t find that the defendant did reply in some way or there is a strong defense offered. Long story short, it seems Nintendo is going to come off with a very easy win here.
UPDATE 2: Nintendo is now attempting to identify multiple individuals who may have worked with a Reddit moderator to operate multiple Switch piracy sites. Nintendo is looking to subpoena multiple companies, including Reddit and Discord.
